2.2. Data collected

Personal data that may be collected includes:

  • Via the contact form: last name, first name, email address, message.
  • Via project exchanges: information voluntarily communicated as part of a consulting engagement (description of needs, technical constraints, shared documents).
  • Via the unsubscribe form: email address only.

2.3. Purpose of processing

Collected data is used exclusively for:

  • Responding to contact and quote requests.
  • Carrying out commissioned consulting engagements.
  • Managing the client relationship (invoicing, follow-up).
  • Processing unsubscribe requests.

No data is sold, transferred, or used for advertising purposes.

2.4. Use of artificial intelligence

In the context of consulting engagements, artificial intelligence tools (LLMs) may be used to assist in the design and construction of commissioned systems. Client data is never transmitted to third-party models without prior pseudonymization or the use of operational cover stories.

The models used (Anthropic Claude, Google Gemini, open-source models) are selected based on their privacy policy and GDPR compliance. Data transmitted to these APIs is not used for model training.

2.6. Data retention period

  • Contact data: 3 years after the last exchange.
  • Project data: duration of the engagement + 12 months (warranty), then deletion.
  • Billing data: 10 years (legal accounting obligation).

2.7. Your rights (GDPR)

In accordance with the General Data Protection Regulation (EU 2016/679), you have the following rights:

  • Right of access to your personal data.
  • Right to rectification of inaccurate data.
  • Right to erasure (\"right to be forgotten\").
  • Right to restriction of processing.
  • Right to data portability.
  • Right to object to processing.

2.8. Transfers outside the EU

Certain sub-processors (Netlify, Notion) are located in the United States and adhere to the EU-U.S. Data Privacy Framework, providing an adequate level of protection recognized by the European Commission (adequacy decision of July 10, 2023).

Terms of Sale

3.1. Purpose

These terms of sale govern the contractual relationship between Murphy Conseil (Tudual Huon, sole proprietor) and any professional or individual client wishing to benefit from consulting services in artificial intelligence, system architecture design, AI solution development, and training.

3.2. Services offered

Murphy Conseil offers the following services:

  • Consulting and audit: needs analysis, strategic recommendations, audit of existing systems.
  • AI system architecture: architecture document design, technical plans, model selection.
  • Development: building AI systems (agents, pipelines, MCP connectors, automations).
  • Documentary deliverables: operating guides, AI-ready guides, evolution roadmaps.
  • Applied research: publications, methodological guides.

3.3. Order process

Every engagement follows this process:

  • First contact and discussion of the need.
  • Preparation of a detailed quote (description of services, timeline, pricing).
  • Client acceptance of the quote (signature or written confirmation by email).
  • Delivery of the engagement following the method described on the site (architecture plan, approval, build, delivery).

A signed or written-accepted quote constitutes a purchase order.

3.4. Pricing and payment

Prices are stated in euros and are net of tax (VAT not applicable, Article 293 B of the French General Tax Code).

Unless otherwise specified in the quote:

  • A 30% deposit is required upon signing the quote.
  • The balance is due upon delivery.
  • Payment by bank transfer within 14 days of receipt of the invoice.

In case of late payment, late payment penalties will be applied at the legal rate in force, increased by 10 points, as well as a flat-rate recovery indemnity of 40 euros.

3.5. Architecture warranty

Every delivered architecture is guaranteed for 12 months from the date of delivery. This warranty covers minor changes (adjustments, corrections, minor configuration updates) at no extra cost.

Excluded from the warranty:

  • Major functional evolutions (new features, architecture overhaul).
  • Modifications made necessary by a change in third-party provider policy (API, deprecated model).
  • Interventions resulting from misuse by the client or unauthorized modifications.

3.6. Intellectual property, traceability, and conditions of use of deliverables

Traceability and protection. All deliverables and architecture documents produced by Murphy Conseil are subject to specific tracking and protection measures that link each architecture to its author. These traceability measures are implemented from design and are maintained throughout the lifetime of the deliverable.

License of use. Full payment of the service grants the client a permanent, non-exclusive license of use over the deliverables. The client is free to use, modify, adapt, and evolve the deliverables within the scope of their own activity or any new activity they develop.

Prohibition of transfer to third parties. Deliverables and architecture documents are designed for the exclusive use of the client named in the quote. Any assignment, resale, making available, transmission, or transfer, whether free or paid, partial or total, of the deliverables to a third-party entity (natural or legal person distinct from the client) is strictly prohibited without the prior written consent of Murphy Conseil. This prohibition applies in particular, without limitation:

  • to the resale or redistribution of delivered architectures, technical documents, or guides;
  • to the transmission to a subsidiary, partner, subcontractor, service provider, or any other legally distinct entity from the client;
  • to the integration of deliverables into a commercial offering intended for third parties.

For projects involving multiple entities, the authorized scope of use is defined in the quote. Any extension requires an additional written agreement.

Violation. Any use of the deliverables in violation of this clause constitutes infringement within the meaning of Articles L.335-2 and following of the French Intellectual Property Code, and may give rise to legal proceedings and a claim for damages.

Portfolio. Murphy Conseil reserves the right to mention the completion of the engagement in its portfolio, unless the client objects in writing.

3.7. Confidentiality

Murphy Conseil undertakes to treat as confidential all information communicated by the client in the context of the engagement. This confidentiality obligation remains in effect for 2 years after the end of the engagement.

3.8. Right of withdrawal (consumers)

In accordance with Articles L.221-18 and following of the French Consumer Code, consumer clients have a 14-day period from the acceptance of the quote to exercise their right of withdrawal, without reason or penalty.

This right does not apply if the performance of the service has begun with the express agreement of the client before the end of the withdrawal period.

3.9. Liability

Murphy Conseil undertakes to provide its services with diligence and in accordance with best practices. This constitutes an obligation of means.

Murphy Conseil's liability shall not be incurred for:

  • Indirect damages (data loss, loss of revenue, commercial harm).
  • Failures of third-party services (APIs, hosts, AI model providers).
  • Use of deliverables by the client outside the provided recommendations.

In any event, Murphy Conseil's financial liability is limited to the total amount of the relevant service.

3.10. Mediation and disputes

In case of dispute, the parties undertake to seek an amicable solution. Failing that, consumer clients may use the consumer mediator free of charge:

In case of a persistent dispute, the competent court is that of Rennes, France.

3.11. Applicable law

These terms of sale are governed by French law. Any dispute shall be submitted to the competent courts of Rennes, France.
